Cal/OSHA Porta Potty Requirements for California Jobsites

California runs its own workplace safety program, so jobsites follow Cal/OSHA Title 8, not only federal OSHA. Here are the toilet and handwashing rules that apply, in plain English.

Two standard porta potties on a dirt jobsite

How many toilets does Cal/OSHA require on a construction site?

Cal/OSHA Title 8 §1526 requires at least 1 toilet for every 20 workers, or fraction of 20. Urinals can count toward the total, but toilets must make up at least half. Single-user units can be designated all-gender, so one row of porta potties can serve a mixed crew.

Federal 29 CFR 1926.51 uses a different table: 1 toilet for 20 or fewer workers, 1 toilet seat and 1 urinal per 40 workers above 20, and 1 seat and 1 urinal per 50 above 200. California sites follow the stricter state rule. Official text: §1526.

Does Cal/OSHA require handwashing on jobsites?

Cal/OSHA Title 8 §1527 requires washing facilities on construction sites, kept sanitary and supplied with soap or cleanser and towels or air dryers. A two-sink handwashing station next to the toilets is the easiest way to comply on sites without running water.

Official text: §1527. See handwashing station rental.

What are the field sanitation rules for farm crews?

Agricultural crews follow Cal/OSHA §3457: 1 toilet and 1 handwashing facility for every 20 workers, within a five-minute walk. Crews in a field for 2 hours or less, including travel time, are exempt. Units must be kept clean and stocked.

How does California's heat rule affect jobsite restrooms?

Cal/OSHA's heat illness rule, §3395, requires water, shade and rest breaks for outdoor workers. It does not set toilet counts, but crews drinking more water use restrooms more often. When a unit serves more than 10 workers in summer heat, add a second weekly service.

What do inspectors check?

Inspectors check that the toilet count matches the crew size, that units are clean and stocked with paper, that handwashing is available, and that units are reachable. A missed delivery is not a defense; that is why same-day delivery matters when a supplier does not show.
